GENERAL TERMS AND CONDITIONS OF SALE

ARTICLE 1 - Scope of Application

These General Terms and Conditions of Sale (GTC) apply, without restriction or reservation, to all sales concluded by ALFIE, SASU, whose registered office is located at 33, rue de Verneuil, 75007 Paris, registered under number 879 270 494 RCS Paris (Seller), with consumers and non-professional buyers (Client(s)) wishing to purchase the products offered for sale by the Seller (Products) on the website www.alfieparis.com (Seller's Website). These GTC specifically outline the conditions for ordering, payment, delivery, and management of any returns of Products ordered by Clients.

Any order placed on the Seller's Website implies unreserved acceptance of these GTC by the Client.

These GTC apply to the exclusion of all other general terms and conditions of purchase or sale. However, they may be supplemented by special conditions stated on the Seller's Website or agreed upon directly with the Client before any transaction.

These GTC are accessible at all times on the Seller's Website. As they may be subject to future modifications, the version applicable to the Client’s purchase is the one in effect on the Seller’s Website at the date of the order.

ARTICLE 2 - Products Offered for Sale

The Products available for purchase on the Seller’s Website include ready-to-wear clothing and fashion accessories. The main characteristics of the Products, including their material, color, size, and delivery timelines, are presented on the Seller’s Website.

Clients are required to review this information before placing an order. The selection and purchase of a Product are the sole responsibility of the Client.

It is specified that the photographs and graphics displayed on the Seller’s Website are non-contractual and do not bind the Seller.

Contractual information is provided in French and confirmed at the latest upon order validation by the Client.

The Products presented on the Seller’s Website are available for sale in the following territories:

  • European Union, Switzerland, Norway, Turkey

  • Russia

  • Morocco, Algeria, Tunisia

  • United States, Canada

  • Japan, China, Korea

  • Australia

  • Argentina, Brazil, Mexico

For any sale outside these territories, the Client may contact the Seller by email at contact@alfieparis.com. The Seller will inform the Client of the feasibility of the sale and, if applicable, provide specific conditions and a quote for shipping costs. The Client must accept this quote within 72 hours for the transaction to proceed.

For orders shipped outside mainland France (including Corsica), the Client is considered the importer of the Products. For all Products shipped outside the European Union and overseas territories, the price will be automatically calculated excluding taxes. Customs duties or other local/import taxes may apply and will be the sole responsibility of the Client.

ARTICLE 3 - Validity of Product Offers

Product offers are valid while stocks last, as indicated at the time of ordering. If stocks are depleted, either (i) new stock is being manufactured, in which case the Product remains available for sale with a longer delivery time, or (ii) the Seller will make the Product unavailable for purchase. Despite all precautions, a Product ordered may exceptionally be unavailable. In such cases, the Seller will promptly inform the Client and, if necessary, refund the full amount paid using the same payment method used by the Client.

ARTICLE 4 - Orders

4-1. Placing an Order

The Client acknowledges having the legal capacity to contract and purchase the Products offered on the Seller’s Website.

After reviewing the Products, the Client can add one or more Products to their virtual cart. A summary of the order is then displayed (Product reference, quantities, unit price, total price including VAT but excluding delivery costs and additional taxes for shipments outside the EU). The Client is also informed about payment methods, delivery options, and the right to return Products within 14 days of delivery.

Once verified, the Client must: (i) log into their account or enter mandatory information for guest checkout, (ii) select or enter billing and shipping addresses, (iii) choose delivery options (timeframes, method, cost).

Finally, the Client: (i) is informed that the order requires payment and that personal data is collected for order fulfillment, (ii) selects a payment method, (iii) unreservedly accepts these GTC, (iv) proceeds to payment.

An order confirmation email summarizing key details and including the GTC (or a download link) is sent to the Client. The sale is then final.

The Seller reserves the right to refuse any order for legitimate reasons, such as unusually high quantities or unresolved payment disputes.

4-2. Order Modification

The Client may modify their order within one (1) hour of receiving the order confirmation email by emailing contact@alfieparis.com.

Modifications are limited to color and/or size changes and must not incur additional costs for the Seller. Adding or removing Products is not permitted.

4-3. Order Cancellation

A confirmed order cannot be canceled. However, the Client has a legal right of withdrawal as outlined in Article 9.

ARTICLE 5 - Pricing

The Seller reserves the right to modify Product prices at any time. Prices are stated in Euros, inclusive of French VAT and applicable taxes but exclude delivery costs and additional taxes for shipments outside the EU.

If the VAT rate changes, prices will be adjusted accordingly.

Specific Client requests (e.g., personalized Products) may require a quote, valid for 72 hours. An invoice is issued upon delivery.

ARTICLE 6 - Payment Terms

Payment is due in full at the time of ordering via secure online payment methods:

  • Credit cards: Visa, MasterCard, American Express

  • Apple Pay

Payments are processed securely via Shopify Payment.

Orders are final only upon successful payment processing. The Seller may suspend or cancel orders if payment conditions are not met.

ARTICLE 7 - Delivery

Products are delivered within 3 to 5 days in mainland France (including Corsica) and within 7 to 10 days for other specified territories.

The Client must verify delivered Products within 3 days and report any issues with supporting evidence (photos, descriptions) to contact@alfieparis.com. Otherwise, Products are deemed conforming.

The Seller will replace or refund defective or non-compliant Products in accordance with consumer laws.

ARTICLE 8 - Transfer of Ownership

Ownership transfers to the Client only upon full payment, regardless of delivery date.

ARTICLE 9 - Right of Withdrawal

The Client has 14 days from receipt to withdraw without reason, provided Products are returned unused, complete, and in original packaging.

Personalized Products are non-returnable.

ARTICLE 10 - Seller’s Liability and Warranty

Products comply with French regulations and non-professional use.
They are covered by:

  • The legal guarantee of conformity (for non-compliant or defective Products)

  • The legal warranty against hidden defects.

The Seller’s liability is limited to replacement or refund of defective/non-compliant Products.

ARTICLE 11 - Data Protection

Client data is necessary for order processing and may be shared with Seller’s partners. The Seller ensures optimal data protection.

ARTICLE 11 – Protection of Personal Data

In accordance with Law No. 78-17 of January 6, 1978, as amended by Law No. 2018-493 of June 20, 2018, it is recalled that the personal data requested from the Client is necessary for processing their order and issuing invoices, among other purposes.

This data may be communicated to potential partners of the Seller responsible for the execution, processing, management, and payment of orders.

The processing of information communicated through the Seller's Website complies with legal requirements regarding personal data protection, with the information system ensuring optimal protection of such data.

The Client has, in accordance with applicable national and European regulations, a permanent right of access, modification, rectification, opposition, portability, and limitation of the processing of their personal information.

This right may be exercised by writing, via mail with proof of identity, to the Seller’s address as indicated in Article 1 of these Terms and Conditions of Sale (TCS).


ARTICLE 12 – Intellectual Property

The content of the Seller's Website is the property of the Seller and its partners and is protected by French and international laws on intellectual property.

Any total or partial reproduction of this content is strictly prohibited and may constitute an act of counterfeiting.


ARTICLE 13 – Applicable Law – Language

These TCS and the transactions arising from them are governed by French law.

They are written in the French language. In the event of translation into one or more other languages, only the French text shall be considered legally binding in case of dispute.


ARTICLE 14 – Disputes

In the event of a complaint, the Client is first invited to contact the Seller in writing, by postal mail at the address indicated in Article 1 of these TCS or by email at contact@alfieparis.com.

If no agreement is reached between the Seller and the Client, the latter may seek free conventional mediation under the conditions set out in Articles L.612-1 et seq. of the French Consumer Code.

To do so, the Client may either:

  • Access the European Online Dispute Resolution platform by clicking the following link: https://ec.europa.eu/consumers/odr/main/index.cfm, or
  • Contact the mediation organization to which the Seller subscribes, MEDICYS:
    • By sending an email to medicys-consommation.fr, or
    • By sending a letter to MEDICYS – 73, Boulevard de Clichy, 75009 Paris.

The mediator’s website is: medicys-consommation.fr.

All disputes arising from purchase and sale transactions concluded under these TCS, concerning their validity, interpretation, execution, termination, consequences, and outcomes, and which cannot be resolved amicably between the Seller and the Client, shall be submitted to the competent courts under common law conditions.


ANNEX I

PROVISIONS RELATING TO LEGAL WARRANTIES

Article L217-4 of the French Consumer Code:

"The seller must deliver goods that conform to the contract and is liable for any conformity defects existing at the time of delivery. The seller is also responsible for defects resulting from the packaging, assembly instructions, or installation when the contract stipulates that these are the seller’s responsibility or when they have been carried out under the seller’s responsibility."

Article L217-5 of the French Consumer Code:

"To conform to the contract, the goods must:

Be suitable for the usual expected use of such goods and, where applicable:

  • Match the description provided by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;
  • Have the qualities that a buyer can legitimately expect in light of public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;

Or possess the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the seller’s attention, and accepted by the latter."

Article L217-12 of the French Consumer Code:

"An action resulting from a conformity defect must be initiated within two years from the date of delivery of the goods."

Article L217-16 of the French Consumer Code:

"When the buyer requests the seller, during the course of the commercial warranty granted at the time of purchase or repair of movable property, to restore the item to its original state under the warranty, any immobilization period of at least seven days is added to the remaining warranty period. This period starts from the date of the buyer’s request for intervention or the availability of the item for repair, whichever is later."

Article 1641 of the French Civil Code:

"The seller is liable for hidden defects in the sold item that render it unfit for its intended use or that so impair its use that the buyer would not have acquired it or would have paid a lower price if they had known of the defects."

Article 1648, Paragraph 1 of the French Civil Code:

"An action resulting from redhibitory defects must be initiated by the buyer within two years from the date the defect was discovered."

This form must be completed and returned only if the Client wishes to withdraw from an order placed on www.alfieparis.com, except in cases of exclusions or limitations on the right of withdrawal as specified in the applicable TCS:
